A prosecutor can dismiss whatever he wants to dismiss. If it is dismissed, then the next one will be treated by law as a first offense. The prosecutor and the judge might be inclined to give the maximum sentence for a first offense, and that might be many months in jail, but it will still be a first offense. If you cannot manage to get to 21 without another, you have a serious alcohol problem. In fact, if you are already planning on what will happen when you have your next illegal drink, you have a serious alcohol problem.
